Terms of Service

1. Acceptance of Terms

By accessing or using the Himalayan Heritage House marketplace, you agree to be bound by these Terms of Service. If you do not agree to these terms, you are prohibited from using the platform.

2. Registration Eligibility

To register and list a business on our portal, you must satisfy the following conditions:

• You must hold a valid business registration under the MSME classification (e.g. Udyam Registration) in Uttarakhand.
• Your physical operations or registered office must be located in one of the 13 districts: Dehradun, Haridwar, Tehri Garhwal, Pauri Garhwal, Uttarkashi, Chamoli, Rudraprayag, Nainital, Almora, Pithoragarh, Udham Singh Nagar, Bageshwar, or Champawat.
• You must provide verified credentials during registration, including business PAN, GSTIN, or Municipal licenses.

3. Seller Code of Conduct

Registered sellers must adhere to standard listing guidelines:

• Accuracy: All descriptions, categories, addresses, and images must represent genuine business attributes.
• Authenticity: Product claims (e.g., "organic", "handloomed") must be backed by appropriate state cooperative or national certifications.
• Zero Spamming: Creation of multiple listings for the same business is prohibited.

4. Intellectual Property Rights

By uploading images or descriptions, sellers grant us a non-exclusive license to host and show that content in the public directory. The Himalayan Heritage House logo and platform layout are protected by national copyright and trademark laws.

5. Limitation of Liability

Himalayan Heritage House acts solely as an informational directory platform. We do not participate in direct financial transactions, delivery logistics, or order fulfillments between sellers and buyers. Any agreement or sale conducted is the sole responsibility of the respective seller and customer. We disclaim all liability arising from commercial disputes or transaction failures.

6. Governing Law & Jurisdiction

These terms are governed by the laws of India. Any disputes arising out of directory operations or platform usage shall be subject to the exclusive jurisdiction of the courts in Dehradun, Uttarakhand, India.

7. Account Termination

We reserve the right to suspend or delete seller accounts that breach these Terms of Service or fail to maintain valid registration requirements inside Uttarakhand.

8. Verification Policy

When you submit an enterprise for listing, you agree to the following verification process. This is the policy referenced on the onboarding review step.

• Submission status: Every new listing is created with a "pending review" status and is not publicly visible until our team completes verification.
• Credential checks: We may cross-check the Udyam registration number, GSTIN, and PAN you provide against the relevant government registries. Providing false or mismatched credentials is grounds for immediate rejection.
• Verified badge: A listing earns the Verified badge only after its Udyam and/or GST details are confirmed. Listings without verifiable credentials remain visible but unbadged.
• Accuracy of details: By checking the consent box you confirm that the business name, category, location, contact details, and uploaded media accurately represent a genuine enterprise you are authorised to list.
• Re-verification: We may periodically re-verify listings. Enterprises that can no longer be verified, or whose registration lapses, may lose the Verified badge or be removed.
• Data use: Verification credentials are used solely to confirm eligibility and are handled in line with our Privacy Policy.
